Hi all I have just read a news paper report that drivers CAN be fined £1000 + 3 points if they have there mot done early [ 1 month to 1 day ] and FAIL the test and then keep driving till there mot runs out. The second you fail your car should be taken of the road even if you have a month to run until the end of your mot

I've often wondered about this. When you think about it, if a car fails the MOT, it could be because of something dangerous and it could then become a hazard to other road users so it makes sense that it should be removed from the road.

Your car is supposed to pass MOT at all times ! So this could in fact happen to you every day. If your car fails at some point you can get a penalty. For instance if your car gets to use oil halfway your MOT leaving a big cloud of black smoke behind your trail...you could get a fine. Or if your car stops breaking properly and you continue to use it unrepaired - mot or no mot -you'll be fined.

I'm an MOT tester and have been asked this by a few customers, I've spoke direct to the DVSA and they say the original MOT still applies and not the later fail

Though as Driving Dutchman rightly points out, your car is meant to be roadworthy so if you did get pulled over and plod noticed a fault, you could (would) still be prosecuted.

An MOT fail (at any time) means your car is not road worthy.

Anyone driving a car on the road, which would fail an MOT is an idiot, and deserves to be prosecuted, banned and castrated.

It is your responsibility not to drive an un-roadworthy car on the road, even if it is not your car.
